QubAds Advertising Policy

This Advertising Policy (“Policy”) governs all advertising activity conducted on the QubAds platform (“Platform”), operated by QubHQ S.R.L. This Policy applies worldwide, with additional regional legal requirements when applicable.
All Brands and Ads are moderated by the QubHQ team based on the criteria of this Policy and applicable laws.
By creating a Workspace, creating or submitting Brands, Campaigns, Ads, or funding campaigns, the Advertiser automatically accepts this Policy and the Terms and Conditions of the Platform.
If the Advertiser does not agree, they must immediately cease all use of the Platform.
1. Definitions
Advertiser: Legal entity operating a Workspace within QubAds.
Workspace: A profile used to manage advertising activity (Brands, Campaigns, Ads, and budgets).
Region: Defined geographical target area selectable within the Platform.
Brand: A business identity created in the Platform and associated with Ads, subject to approval by QubHQ.
Campaign: A budgeted advertising entity that competes for Ad slots, has an assigned Region, and can run Ads from one or more Brands at the same time.
Ad: A promotional item inserted into participating digital menus and clearly marked as advertising.
Partner Location: A venue using QubMenu that participates in displaying QubAds within its digital menu.
Campaign Period: A recurring calendar-month period (1st to last day).
2. Moderation & Approval Principle
2.1 All Brands, Campaigns, and Ads are subject to moderation (manual and/or automated) by QubHQ.
2.2 Approval is based on:
this Policy
applicable laws
Partner Location preferences
Platform integrity considerations
2.3 QubHQ may deny, restrict, suspend, or remove any Workspace, Advertiser, Brand, Campaign, or Ad content at sole discretion, without obligation to justify decisions.
3. Eligibility & Workspace Requirements
3.1 Advertisers must be legally registered entities or legally authorized representatives.
3.2 Advertisers must provide factual, legal, and verifiable business information.
3.3 QubHQ may require additional verification at any time.
4. Campaign Region Assignment
4.1 Regions are assigned to Campaigns, not to Workspaces.
4.2 A Workspace may create and manage multiple Campaigns, including Campaigns targeting different Regions.
4.3 Each Campaign is dedicated to one specific Region. Advertising in multiple Regions requires separate Campaigns.
4.4 All regional compliance obligations, Partner Location exclusions, and auction competition are applied based on the Campaign’s assigned Region.
5. Prohibited Business Types
5.1 Food-Serving Businesses (Restricted Scope)
Only Ads that explicitly promote restaurants or bistros are prohibited.
This includes Ads that directly advertise:
restaurants
bistros
fast-food venues
pubs and bars when promoted as a venue
food trucks
catering services
any venue whose primary activity is preparing or selling food for on-site consumption
This restriction applies to explicit venue promotion.
5.2 Gambling and Chance-Based Businesses (Allowed, Strictly Moderated)
Gambling-related advertisers (casinos, betting agencies, fantasy sports, lotteries, raffles) may be allowed, but are strictly moderated and displayed only in Partner Locations that approve such Ads and only where legally permitted.
5.3 Other Restricted or Sensitive Business Types (Allowed, Strictly Moderated)
Including but not limited to regulated or sensitive industries such as:
alcohol
financial products
health-related products or services
These may be allowed only under strict moderation, regional compliance, and Partner Location approval.
5.4 Always Prohibited (Platform-Wide)
Including but not limited to:
illegal or unlicensed regulated industries
weapons or explosives
pornographic or sexual services
unauthorized pharmaceuticals or unapproved medical claims
high-risk financial products without regulatory approval
QubHQ may modify or expand this list at any time.
6. Ad Content Restrictions
6.1 Advertisers may only promote products or services they own and directly provide, or that they are legally authorized to promote.
6.2 Third-party advertising, reseller misrepresentation, and deceptive affiliate promotions are prohibited.
6.3 Accuracy Required
All claims must be truthful and compliant with applicable regional regulations.
6.4 Content Not Allowed
misleading, harmful, discriminatory, violent, or unlawful content
health or environmental claims lacking evidence where required by law
political advocacy unless explicitly authorized in writing by QubHQ and legally permitted
6.5 Language Requirements
Ad content must be available in platform-approved languages for the chosen Region.
7. Partner Controls, Brand Exclusions, and Eligibility by Location
7.1 Partner Locations may exclude specific Brands and/or categories from appearing in their digital menu.
7.2 If a Partner Location excludes a Brand:
Ads associated with that Brand will not be displayed in that Partner Location
Ads may still be displayed in other Partner Locations where the Brand is permitted
7.3 Partner exclusions do not guarantee refunds and do not create any obligation to deliver impressions.
8. Brand, Campaign, and Ad Workflow
8.1 Create Brand(s)
Brands must be created and approved by QubHQ before being eligible for display.
8.2 Create Campaign
A Campaign must be created, have a daily budget set, and have an assigned Region to participate in auctions.
8.3 Attach Ads to Campaign
Ads are created under a Brand and then attached to a Campaign. A Campaign can run Ads from more than one Brand simultaneously.
8.4 Effect of Brand Rejection or Removal
If a Brand is rejected or removed:
all associated Ads are archived and/or automatically hidden
any Campaign that contains only Ads from removed or rejected Brands becomes ineligible in affected locations
8.5 Location-Based Ineligibility
If a Brand is not allowed in a Partner Location due to Partner preferences or legal constraints:
Ads associated with that Brand will not be displayed in that Partner Location
8.6 No Eligible Ad at the Time of Winning
If a Campaign wins a slot but has no approved and eligible Ads for the specific Partner Location, the Campaign is ignored for that slot and another eligible Campaign may be selected.
9. Ad Slot Selection & Display Mechanism
QubAds uses a fair weighted-probability algorithm to determine which Campaign wins each advertising slot inside a digital menu.
Key Principles
Slots are variable per menu (dynamic placement opportunities)
Slot placement is randomized but influenced by configured criteria
Higher daily budget share increases probability of selection
Budget normalization and probability basis
9.1 Each Campaign’s daily budget is normalized within a Platform-defined range between a minimum daily budget and a maximum daily budget applicable to the relevant market context.
9.2 QubHQ may change these minimum and maximum ranges at any time, including materially or substantially, and such changes may affect Campaign competitiveness, probability of selection, and display frequency.
9.3 A Campaign’s probability of being selected and displayed is correlated with its normalized daily budget value within the applicable range.
9.4 The probability outcome is also market-dependent and based on the total competitive daily budget in the relevant market, which includes:
all other Campaigns targeting the same market context, and
Campaigns owned by the same Workspace as the Campaign itself.
10. Visibility Depends on Partner Network
10.1 Ad visibility is not guaranteed.
10.2 Visibility is influenced by:
the number of Partner Locations actively using QubMenu and participating in QubAds
Partner exclusions and category approvals
competition levels within the Campaign’s Region and market context
budget distribution and auction dynamics
regional legal restrictions
11. Campaign Period & Daily Budget Rules
11.1 Campaign cycles run monthly (1st to last day).
11.2 The total payment allocated to a Workspace or Campaign is distributed as Daily Budget.
11.3 Campaign participation requires an active daily budget.
11.4 Daily budgets activate when the Campaign becomes eligible in the auction pool.
11.5 Daily Budget may roll only into the next immediate month, subject to platform rules.
12. Marketplace Budgets: Normal Budget and Reward Budget
12.1 QubAds supports two types of budget:
Normal Budget
used for standard auction participation
minimum daily budget for a Campaign is 5 EUR, converted at the exchange rate of the day
Reward Budget
can be used on top of Normal Budget
has no minimum daily rate requirement
does not replace the Normal Budget minimum for Campaign participation
13. Payments, Top-Ups, and Refunds
13.1 Once an Advertiser tops up or funds the system, no refunds are issued, even if the budget is not spent.
13.2 QubHQ S.R.L. will not refund any amount under any circumstances, except where mandatory law explicitly requires otherwise.
14. Affiliate Rewards
14.1 If you are an Affiliate, you receive 10% of the top-up value of any affiliated Workspace top-up, where attribution is determined by the email address associated with the Affiliate relationship.
14.2 The Affiliate reward is credited as Reward Budget in the Affiliate’s QubDigital account.
15. Compliance, Enforcement & Suspension
Violations may result in:
immediate removal of Ads
Campaign suspension or deactivation
Workspace deactivation
permanent ban
loss of all allocated budgets
legal reporting to authorities when required
QubHQ may take preemptive action to protect Platform integrity.
16. Regional Laws & Governing Compliance
Regional legal frameworks override the Platform in case of conflict.
Advertisers must ensure compliance with:
consumer protection laws
advertising regulations
industry-specific compliance standards
Failure may result in legal liability exclusively borne by the Advertiser.
17. Indemnification
The Advertiser agrees to fully indemnify QubHQ S.R.L. for any claims, losses, costs, or regulatory penalties arising directly or indirectly from:
their Ads, Brands, or Campaigns
their business activities
their violations of this Policy
18. Modification of Policy
QubHQ may update this Policy at any time. Continued use of the Platform confirms acceptance of changes immediately upon publication.
