QubAds Advertising Policy

This Advertising Policy (“Policy”) governs all advertising activity conducted on the QubAds platform (“Platform”), operated by QubHQ S.R.L. This Policy applies worldwide, with additional regional legal requirements when applicable.
By creating a Workspace, submitting Ads, or funding campaigns, the Advertiser automatically accepts this Policy and the Terms and Conditions of the Platform.
If the Advertiser does not agree, they must immediately cease all use of the Platform.
1. Definitions
Advertiser: Legal entity operating a Workspace within QubAds.
Workspace: A region-specific profile used to run Ads.
Region: Defined geographical target area selectable within the Platform.
Ad: A promotional item inserted into participating digital menus and clearly marked as advertising.
Campaign Period: A recurring calendar-month period (1st to last day).
2. Eligibility & Workspace Requirements
2.1 Advertisers must be legally registered entities or legally authorized representatives.
2.2 Each Workspace is dedicated to one specific Region. Separate Regions require separate Workspaces.
2.3 QubHQ may deny, restrict, or remove any:
Workspace
Advertiser
Ad content
at sole discretion, without obligation to justify decisions.
2.4 Advertisers must supply factual, legal, and verifiable business information.
3. Prohibited Business Types
Advertisers cannot participate if their business falls into any of the following categories:
3.1 Food-Serving Businesses
❌ Completely banned:
Restaurants
Bistros
Fast-food
Pubs and bars
Food trucks
Caterers
Any business whose primary activity involves preparing or selling food for consumption in store
Narrow Beverage Exception
✔ Businesses focused primarily on non-food beverages may advertise beverages only, with proof of business structure required.
3.2 Gambling and Chance-Based Businesses
Casinos, betting agencies, fantasy sports, lotteries, raffles
3.3 Other Prohibited Business Types
Including but not limited to:
Illegal or unlicensed regulated industries
Weapons or explosives
Pornographic or sexual services
Unauthorized pharmaceuticals, medical claims
High-risk financial products without regulatory approval
QubHQ can modify or expand this list at any time.
4. Ad Content Restrictions
4.1 Advertisers may only promote products or services they own and directly provide.
4.2 Third-party advertising or affiliate promotions are strictly prohibited.
4.3 Accuracy Required
All claims must be truthful and compliant with applicable regional regulations.
4.4 Content Not Allowed
Misleading, harmful, discriminatory, violent, or unlawful content
Health/environment claims lacking approved evidence
Political advocacy unless authorized by QubHQ
4.5 Language Requirements
Ad content must be available in platform-approved languages for the chosen Region.
5. Ad Slot Selection & Display Mechanism
QubAds uses a fair weighted-probability algorithm to determine which advertiser wins each advertising slot inside a digital menu.
Key Principles
Slots are variable per menu (dynamic placement opportunities)
Slot placement is randomized but influenced by configured criteria
Higher daily budget share = higher probability of selection
5.1 Daily Weight Calculation
Every Advertiser receives a Daily Advertising Weight based on:
Daily Weight = Advertiser Daily Budget ÷ Total Daily Budget of Region
This determines the probability of selecting that Advertiser for each slot.
5.2 Participation After Winning a Slot
If selected for a slot:
Advertiser remains eligible for the next slot,
But with a 50% temporary weight reduction applied immediately after the win.
This reduction:
Applies cascading to the next selection attempt
This prevents monopolizing while preserving proportional advantage.
5.3 Ad Creative Rotation
Once an Advertiser wins a slot:
One active Ad is selected from the Advertiser’s Ad inventory
Selection prioritizes performance and relevance,
But includes randomness to ensure rotation
!The same Ad will not appear multiple times in the same digital menu.
5.4 No Guarantees
QubAds does not guarantee:
A minimum number of impressions or displays
A minimum number of wins per menu
Specific engagement results
6. Campaign Period & Daily Budget Rules
6.1 Campaign cycles run monthly (1st → last day).
6.2 The total payment allocated to a Workspace is distributed as Daily Budget:
Daily Budget = Total Payment ÷ 30 (standard assumed period)
If month ≠ 30 days → system automatically adjusts proportionally
6.3 Daily Budget activates on the date the Workspace enters the active auction pool.
Example:
Payment: 30 EUR
Month: 30 days
Daily Budget = 1 EUR/day
Activation: Day 15 → 16 EUR available this month
Remaining 14 EUR → allocated to next month
6.4 Daily Budget can roll only into the next immediate month
6.5 No refunds under any circumstances.
6.6 Advertisers acknowledge performance varies by competitive landscape.
7. Compliance, Enforcement & Suspension
Violations may result in:
Immediate removal of Ads
Workspace deactivation
Permanent ban
Loss of all allocated budgets
Legal reporting to authorities when required
QubHQ may take preemptive action to protect Platform integrity.
8. Regional Laws & Governing Compliance
Regional legal frameworks override the Platform in case of conflict.
Advertisers must ensure compliance with:
Consumer protection laws
Advertising regulations
Industry-specific compliance standards
Failure may result in legal liability exclusively borne by the Advertiser.
9. Indemnification
The Advertiser agrees to fully indemnify QubHQ S.R.L. for any claims, losses, costs, or regulatory penalties arising directly or indirectly from:
Their Ads
Their business activities
Their violations of this Policy
10. Modification of Policy
QubHQ may update this Policy at any time.
Continued use of the Platform confirms acceptance of changes immediately upon publication.
